Fed appeals court panel says most Obamacare subsidies illegal

Story

In a potentially crippling blow to Obamacare, a federal appeals court panel declared Tuesday that government subsidies worth billions of dollars that helped 4.7 million people buy insurance on HealthCare.gov are illegal.

The law’s latest legal problem is that, as written, people who enroll in Obamacare through the federal exchange aren’t eligible for subsidies. The text of the law only provides subsidies for people enrolled through “an Exchange established by the State,” according to the text of the Affordable Care Act. Only 16 states decided to establish the exchanges.

The Supreme Court ruled Monday that some corporations can hold religious objections that allow them to opt out of the new health law requirement that they cover contraceptives for women.

The justices' 5-4 decision is the first time that the high court has ruled that profit-seeking businesses can hold religious views under federal law. And it means the Obama administration must search for a different way of providing free contraception to women who are covered under objecting companies' health insurance plans.

I remember the news reports after Bergdahl was first captured. More than a few stories emerged that Bergdahl deserted. Most of these accounts were from unnamed sources, probably because military personnel familiar with the facts were barred from speaking about them. Despite some searching around, I haven't been able to find a "smoking gun" that answers the desertion question. My Army friends all seem to believe he deserted, FWIW. Here's a little write up that has been floating around the Internet for awhile. There is no source attribution, nor has its authenticity been proven:

I WAS THERE. I'm sick of all the lies. Here is the TRUTH, from someone on the ground. We were at OP Mest, Paktika Province, Afghanistan. It was a small outpost where B Co 1-501st INF (Airbone) ran operations out of, just an Infantry platoon and ANA counterparts there. The place was an Afghan graveyard. Bergdahl had been acting a little strange, telling people he wanted to "walk the earth" and kept a little journal talking about how he was meant for better things. No one thought anything about it. He was a little “out there”. Next morning he's gone. We search everywhere, and can't find him. He left his weapon, his kit, and other sensitive items. He only took some water, a compass and a knife. We find some afghan kids shortly after who saw an american walking north asking about where the taliban are. We get hits on our voice intercepter that Taliban has him, and we were close. We come to realize that the kid deserted his post, snuck out of camp and sought out Taliban… to join them. We were in a defensive position at OP Mest, where your focus is to keep people out. He knew where the blind spots were to slip out and that's what he did. It was supposed to be a 4-day mission but turned into several months of active searching. Everyone was spun up to find this guy. News outlets all over the country were putting out false information. It was hard to see, especially when we knew the truth about what happened and we lost good men trying to find him. PFC Matthew Michael Martinek, Staff Sgt. Kurt Robert Curtiss, SSG Clayton Bowen, PFC Morris Walker, SSG Michael Murphrey, 2LT Darryn Andrews, were all KIA from our unit who died looking for Bergdahl. Many others from various units were wounded or killed while actively looking for Bergdahl. Fighting Increased. IEDs and enemy ambushes increased. The Taliban knew that we were looking for him in high numbers and our movements were predictable. Because of Bergdahl, more men were out in danger, and more attacks on friendly camps and positions were conducted while we were out looking for him. His actions impacted the region more than anyone wants to admit. There is also no way to know what he told the Taliban: Our movements, locations, tactics, weak points on vehicles and other things for the enemy to exploit are just a few possibilities. The Government knows full well that he deserted. It looks bad and is a good propaganda piece for the Taliban. They refuse to acknowledge it. Hell they even promoted him to Sergeant which makes me sick. I feel for his family who only want their son/brother back. They don’t know the truth, or refuse to acknowledge it as well. What he did affected his family and his whole town back home, who don’t know the truth. Either way what matters is that good men died because of him. He has been lying on all those Taliban videos about everything since his “capture”. If he ever returns, he should be tried under the UCMJ for being a deserter and judged for what he did. Bergdahl is not a hero, he is not a soldier or an Infantryman. He failed his brothers. Now, sons and daughters are growing up without their fathers who died for him and he will have to face that truth someday.

I really hope we didn't get a bunch of servicemen killed and trade off dangerous Taliban commanders for a deserter.

Well the reports are out now. Sounds like he deserted. Lame. If RRP were posting here, I wonder if he wouldn't have some larger conspiracy about this. Either way, I suspect that Obama didn't go through Congress because he wanted to draw attention away from the VA scandal and this is part of his 'more diplomacy' foreign policy.

This is the worst president in the last 100 years. People always think Nixon was the worst president but he helped get us out of Vietnam. What he did was spy on everyone and get caught? Guess what Obama does? SPY ON EVERYONE. On top of that, he's done the whole health care thing, used the IRS as a tool against his political enemies (100+ white house visits by IRS leader). He didn't get us out of Afghanistan like he promised. He has raised health care for everyone, screwed over doctors and patients. He's actually LOST health care for millions of people. He has many other scandals way worse than Clinton ever had. Clinton was 100x better than Obama and that's really sad. They were saying he has way more death threats than anyone previously. Is it sad that the first 1/2 black president has also been the worst? He certainly didn't do anything for advancing black people. You could also mention the deaths at the "bengazi" (spelling) or the worst of all, cowering down to IRAN who has FUCKING STATE SUPPORTED TERROR. Bush was dumb and set us back many years, but this dude has set us back even worse. National Debt? What really gets me is with all this going on, there's still these dumbfucks that support this guy. How dumb are they? They're saying this guy is setting Democrats back so bad they're going to take forever to recover.


I think the reason everyone is bitter all the time (including myself) is because we're ALL being shit on no matter who is in office. It only gets worse. It's coming from the left and the right and everyone wants to play the blame game. Washington is the corrupt evil heart of our nation and it needs cut out.

This is why I don't even follow American politics any more, life just sucks when you focus on the worst parts. I'll just stick my head in the sand and wait for it all to collapse and know that I've done my best to prepare for the worst.

Whoever mentioned that the deficit shrinking as a good sign needs to wake up. The Fed has been pumping 80+ billion dollars a month in imaginary assets into our economy for years now. If our deficit is shrinking without us actually taking ANY substantial actions whatsoever to address the deficit do you really think Obama deserves some sort of credit for this? Is the fact that it is shrinking despite this even a good sign?

Willful ignorance turns me into a giant asshole on internet forums, I can't help it. I can't imagine seeing through the eyes of some people, believing what they believe. Once you know things, you can't forget them.
